Welcome to Mad Haven Designs. By using this website or engaging my web design services, you agree to the following Terms of Service.
1. Services
I provide web design and related creative services, which may include website design, website development, graphic design, content organization, and website maintenance.
The specific services included in a project will be outlined in the project proposal and/or contract provided to the client.
2. Project Scope
Each project will have an agreed-upon scope of work outlining the pages, features, deliverables, timeline, and services included.
Requests that fall outside the agreed-upon scope may require additional fees and/or an updated timeline. Additional work will be discussed and approved before it begins.
3. Payments
Project pricing and payment schedules will be outlined in the applicable proposal and contract.
Unless otherwise agreed upon in writing, projects require a 50% deposit before work begins, with the remaining balance due prior to the final website launch.
The initial deposit reserves project time and is non-refundable once work has begun.
I reserve the right to pause work on a project if an invoice becomes overdue.
4. Revisions
The number of revisions included in a project will be specified in the project proposal or contract.
For projects that include two rounds of revisions, each round allows the client to provide feedback and requested changes to the current design or deliverables.
Additional revisions or changes outside the agreed-upon scope may be subject to additional fees.
5. Client Responsibilities
The client is responsible for providing accurate and timely content, including text, images, logos, business information, and other materials necessary to complete the project.
The client is also responsible for reviewing and approving designs, content, and functionality in a timely manner.
Delays in providing content, feedback, or approvals may affect the project timeline.
6. Client-Provided Materials
The client represents that they have the necessary rights and permissions to use any text, images, logos, photographs, videos, or other materials they provide for the project.
The client is responsible for ensuring that any materials they provide do not infringe upon the rights of another person or organization.
7. Website Content and Accuracy
The client is responsible for reviewing and approving the final content of their website before launch.
I am not responsible for errors, omissions, or inaccuracies in client-provided information that has been approved for publication.
8. Third-Party Services
Websites may require third-party services, platforms, software, plugins, applications, hosting providers, domain registrars, payment processors, or other services.
Unless specifically included in the project agreement, fees associated with third-party services are the client's responsibility.
I am not responsible for changes, outages, pricing increases, or service interruptions caused by third-party providers.
9. Website Hosting and Domain Names
Unless otherwise agreed upon in writing, the client is responsible for purchasing and maintaining their domain name and any required hosting or third-party subscriptions.
If I assist with setting up or managing these services, the client remains responsible for applicable account and subscription fees.
10. Intellectual Property
Upon receipt of full payment, the client will receive ownership of the final website design and original project materials specifically created for the client, except for third-party materials, fonts, software, templates, plugins, stock assets, or other materials that are subject to separate licenses or ownership rights.
I retain ownership of my pre-existing materials, processes, tools, templates, and reusable design resources.
11. Portfolio Use
Unless otherwise agreed upon in writing, I may display completed work created for the client in my portfolio, website, social media, and other promotional materials for the purpose of showcasing my services.
If the client requires the project to remain confidential or does not want the work publicly displayed, this should be discussed and agreed upon in writing before the project begins.
12. Project Cancellation
Either party may request to end a project by providing written notice.
If a client cancels a project after work has begun, payments already made will generally not be refundable and the client may be responsible for payment for work completed or expenses incurred up to the cancellation date.
Specific cancellation terms may be outlined in the project contract.
13. Website Maintenance
Website maintenance, updates, content changes, troubleshooting, and ongoing support are not included unless specifically stated in the project proposal or contract.
Additional services requested after completion of the project may be billed separately.
14. Limitation of Liability
I will make reasonable efforts to provide professional and functional services. However, I cannot guarantee that a website will be completely free from errors, interruptions, security vulnerabilities, or compatibility issues.
To the fullest extent permitted by law, I am not responsible for indirect, incidental, consequential, or lost-profit damages resulting from the use of the website or services provided.
15. Results
I do not guarantee specific business results, including a particular number of visitors, leads, sales, search engine rankings, or revenue as a result of website design or development services.
16. Changes to These Terms
I reserve the right to update these Terms of Service as my services, business practices, or website change.
Any updates will be posted on this page with a revised "Last Updated" date.
17. Governing Law
These Terms of Service shall be governed by the laws of the State of Connecticut, without regard to its conflict-of-law principles, unless otherwise required by applicable law.
